Terms of engagement
What I do, what I don't do, what it costs, and what each of us is responsible for.

Your written confirmation governs, not this page
This page sets out the general basis on which I work. Every engagement is confirmed in writing before it starts, with the scope, the capped fee and the timeframe for your matter set out in that confirmation. Where the two differ, the written confirmation for your matter governs.
Nothing on this website is an offer to act, and no engagement exists until I have confirmed it in writing and you have accepted.
What you are engaging me to produce is narrower than people expect, and that is deliberate.
The work is a written finding about what your records establish
I read clinical records and report what they establish and where they stop. The output is a written finding: what your documentation supports, what it does not, and what it would take to close the gap.
The free 15-minute call exists to work out whether the work is a fit. It carries no fee and no obligation on either side, and it is not an assessment of your matter.
Four things it is not, each of which someone has assumed at some point.
It is not legal advice, advocacy, treatment, or a promise of an outcome
- Not legal advice. I am a physiotherapist, not a lawyer. I do not advise on review rights, time limits, what to lodge, or your legal position. Those belong with a solicitor or a disability advocate, and free advocacy services exist. I am happy to point you to one.
- Not a promise of an outcome. No finding, report or opinion I produce can guarantee that a decision goes your way. Decisions are made by the Agency and, on review, by the Tribunal, on the whole of the material before them.
- Not advocacy. My duty in producing evidence is to the accuracy of the opinion, not to your case. If the records do not support what you hoped they would, the finding will say so. That is what makes it worth having.
- Not treatment, unless treatment is separately and clinically indicated in its own right, agreed in writing, and provided as its own engagement. I deliver no funded supports to anyone whose file I have audited, or whose future funding depends on a report I wrote.
Which brings us to how it is paid for.
The fee is capped before the work starts, and the cap only moves down
A cap is the most you can be charged. It is agreed in writing before the work begins. If your history is shorter than described and the work is quicker, the invoice is lower and you will know the figure before it is issued. It does not move upward. A file that turns out to be twice the size either of us expected is still charged at the cap.
If the volume of records is materially greater than described, I will stop and tell you before doing anything that would change the scope we agreed.
- Evidence Audit$850
- Report from your records$1,650
- Assessment, then report$2,250
- Hearing, if neededQUOTED FIRST
If your NDIS plan is paying, there are no deposits. Before any work starts, we sign a service agreement and the amount is set aside in your plan, with your plan manager if you have one. Nothing is claimed until the work is complete and you've read and approved it. Nothing after the audit is quoted until the audit has been done.
If you're paying privately, there's a deposit before work starts: $250 for an Evidence Audit, and $500 for a report. The balance is paid once the work is delivered.
All plan types can fund this work. I am a registered NDIS provider, so agency-managed participants can engage me as well as self-managed and plan-managed participants. Registration changed who can engage me. It has never been what my independence rests on: that is the separation of supports set out above.
Some of what the work needs is yours to supply.
What each of us is responsible for
- You provide them, and you confirm you are entitled to. A finding can only be as complete as the material it is drawn from. If something material is missing, the finding will say what is missing rather than assume its contentsYOUR RECORDS
- Tell me any date you are relying on at the outset. Some timeframes cannot be met honestly, and I would rather say so than take the work. Confirming a legal deadline is a solicitor's or an advocate's job, not mineDATES
- What you tell me about your daily function forms part of the material I work from. It needs to be accurate, including on the days that are better than the worst onesACCURACY
- I will not alter a finding to suit a preferred conclusion, and I will not omit something material because it is unhelpfulMY INDEPENDENCE
And the ordinary terms that cover everything else.
Cancellation, copyright, complaints and governing law
You may end an engagement at any time in writing. You are charged for work done up to that point. I may decline or withdraw from an engagement where I cannot act independently, where the material does not permit an honest opinion, or where the scope has changed beyond what was agreed. In that case, you are charged only for work done.
Reports are prepared for you and for the purpose stated in them. Copyright in a report stays with me; you have an unrestricted licence to use it for that purpose, including providing it to the Agency, the Tribunal, or your representatives.
If something has gone wrong, tell me first. If that does not resolve it, physiotherapy practice complaints can go to AHPRA or to the Health Complaints Commissioner in Victoria. Nothing in these terms limits rights you have under the Australian Consumer Law that cannot lawfully be limited.
These terms are governed by the law of Victoria.
